In three parts, this volume in the AP-LS series explores the phenomena of captivity and risk management, guided and informed by the theory, method, and policy of psychological jurisprudence. The authors present a controversial thesis that demonstrates how the forces of captivity and risk management are sustained by several interdependent "conditions of control." These conditions impose barriers to justice and set limits on citizenship for one and all. Situated at the nexus of political/social theory, mental health law and jurisprudential ethics, (...) the book examines and critiques constructs such as offenders and victims; self and society; therapeutic and restorative; health; harm; and community. So, too, are three "total confinement" case law data sets on which this analysis is based. The volume stands alone in its efforts to systematically "diagnose" the moral reasoning lodged within prevailing judicial opinions that sustain captivity and risk management practices impacting: (1) the rights of juveniles found competent to stand criminal trial, the mentally ill placed in long-term disciplinary isolation, and sex offenders subjected to civil detention and community re-entry monitoring; (2) the often unmet needs of victims; and (3) the demands of an ordered society. This article further elaborates on the “pre-crime society” thesis as developed and examined by Arrigo and Sellers. Specifically, the article focuses on the ultramodern era of digital inter-connectivity and argues that productive psychic desire is held clinically captive. Ultra-modernity is populated by cyber-forms of human relating and of economic exchange that nurture hyper-securitization. We discuss how the maintenance of hyper-securitization supports a pre-crime society, and how hyper-securitization’s object of desire consists of sign-optics. We argue that the co-constitutive forces of (...) this desire represent the sign-exchange values of post-criminology. Post-criminology’s signifiers include, among others, “predictive policing”, “crime mapping”, and “actuarial penology.” Post-criminology’s signifieds produce captivity-generating bio-digital “laws” of human relatedness. Among others, these laws sanction the neurosis of de-vitalization and certify the psychosis of finalization. We explain how the unchecked excess neutralizations of de-vitalization and finalization cultivate clinical captivity. Clinical captivity is a social anxiety in which reciprocal consciousness, inter-subjectivity, and mutual power are limited in existence or are denied an existence. (shrink)

An indispensable collection that re-examines what it means to belong in the world. "Where are you from?" The word cosmopolitan was first used as a way of evading exactly this question, when Diogenes the Cynic declared himself a “kosmo-polites,” or citizen of the world. Cosmopolitanism displays two impulses—on the one hand, a detachment from one’s place of origin, while on the other, an assertion of membership in some larger, more compelling collective. Cosmopolitanisms works from the premise that there is more (...) than one kind of cosmopolitanism, a plurality that insists cosmopolitanism can no longer stand as a single ideal against which all smaller loyalties and forms of belonging are judged. Rather, cosmopolitanism can be defined as one of many possible modes of life, thought, and sensibility that are produced when commitments and loyalties are multiple and overlapping. Featuring essays by major thinkers, including Homi Bhabha, Jean Bethke Elshtain, Thomas Bender, Leela Gandhi, Ato Quayson, and David Hollinger, among others, this collection asks what these plural cosmopolitanisms have in common, and how the cosmopolitanisms of the underprivileged might serve the ethical values and political causes that matter to their members. In addition to exploring the philosophy of Kant and the space of the city, this volume focuses on global justice, which asks what cosmopolitanism is good for, and on the global south, which has often been assumed to be an object of cosmopolitan scrutiny, not itself a source or origin of cosmopolitanism. The ultramodern condition represents the "third wave" in postmodernist-inspired philosophy and cultural practice. Two of ultramodernism's critical theoretical components are the human/social forces, flows, and assemblages that sustain transgression; and the human/social intensities, fluctuations, and thresholds that make transcendence possible as both will and way. In the ultramodern age, then, transcendence is about overcoming and transforming the conditions (i.e., forces, flows, and assemblages) that co-produce harm-generating (i.e., transgressive) tendencies. This manuscript problematizes transgression by way of ultramodern theory. This critical investigation (...) represents "the phenomenology of the shadow," or the ultramodern philosophy of harm. To contextualize this phenomenology and philosophy, the intellectual history of ultramodern thought is recounted. This includes a review of the shadow construct by way of its prominent socio-cultural, psychoanalytic, and political-economic currents; and a chronicling of the reification process (regarding risk, captivity, and harm) since the modernist era (i.e., the industrial revolution). The article concludes with some very speculative observations concerning "the phenomenology of the stranger," or the ultramodern philosophy of transcendence as both will and way. (shrink)

Western Political Thought in Dialogue with Asia is a unique collection of essays that examines the exchange of political ideas between Western Europe and Asia from the Middle Ages to the early twentieth century. The contributors to the volume call for globalizing the scope of research and teaching in the history of political thought.

Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

The idea and use of the concept of intrinsic value in environmental ethics has spawned much debate in environmental ethics/axiology. Although for many, it seems fundamental and necessary for formulating an ethic for environmental protection, it seems to confuse and even undermine such efforts. ' Intrinsic value ' is, I argue, a concept born in the Western intellectual tradition for purposes of insulating and isolating those to whom intrinsic value can be attributed from one another and their environmental context. This (...) is especially true from the Modern period onward. When used as a basis for determining moral considerability, these Modern foundations engender contradictory and self-defeating ways of thinking about the individual/ecosystem relationship. As a result, formulations of moral sensibilities and principles become self-defeating and, vis-à-vis the ecological context, incoherent. On the critique of this Modern residue, an alternative axiological framework is built, using Anthony Weston's idea of interdepending values as a preparation for a more ecologically coherent approach to environmental protection. This approach is dialectical and attempts to formulate an ecological foundation for moral considerability. (shrink)

Words of Life is the sequel and companion to Phenomenology and the "Theological Turn," edited by Dominique Janicaud, Jean-Francois Courtine, Jean-Louis Chrétien, Michel Henry, Jean-Luc Marion, and Paul Ricoeur. In that volume, Janicaud accuses Levinas, Henry, Marion, and Chrétien of "veering" from phenomenological neutrality to a theologically inflected phenomenology. By contrast, the contributors to this collection interrogate whether phenomenology's proper starting point is agnostic or atheistic. Many hold the view that phenomenology after the theological turn may very well be true (...) both to itself and to the phenomenological "things themselves." In one way or another, all of these essays contend with the limits and expectations of phenomenology. As such, they are all concerned with what counts as "proper" phenomenology and even the very structure of phenomenology. None of them, however, is limited to such questions. Indeed, the rich tapestry that they weave tells us much about human experience. Themes such as faith, hope, love, grace, the gift, the sacraments, the words of Christ, suffering, joy, life, the call, touch, listening, wounding, and humility are woven throughout the various meditations in this volume. The contributors use striking examples to illuminate the structure and limits of phenomenology and, in turn, phenomenology serves to clarify those very examples. Thus practice clarifies theory and theory clarifies practice, resulting in new theological turns and new life for phenomenology. St. Louis University St. Louis, Missouri IT IS A COMMONPLACE that various philosophies, besides being supremely important intellectually and morally to individuals, have exercised a powerful influence on culture through their proponents acting individually and in schools. Sometimes, too, philosophers and theologians made venerable by antiquity are cited in policy disputes, both secular and ecclesiastical, which have a (...) definite political aspect. The obvious hope is that the struggle can be won more easily with the added support of a revered authority. This seems to have been the case recently in the debate over homosexuality. Bruce Williams, O.P., wrote a commentary 1 on a letter from the Roman Catholic Congregation for the Doctrine of the Faith, " On the Pastoral Care of Homosexual Persons," in which he adopts the position that the homosexual condition cannot be considered "all right". He bases his argument explicitly on the scholastic maxim ' agere sequitur esse' (acting fol.., lows being) ; if the action is distorted, so is the condition from which it follows. But in disputing this position another commentator on the Roman letter, Gerald D. Coleman, S.S.,2 has named Thomas Aquinas as a key scholastic philosopher who should logically be counted as his own ally. DALY, S.J. that although Thomas" would name the homosexual activity... as ' distorted '," he would not think of the homosexual condition in this way.3 Before entering in detail into Thomas's actual thought on the matter, it seems important for humanitarian reasons to note specifically, as did the Roman Letter, Williams, Coleman, and Thomas himself, that a disordered condition need not imply moral culpability. The case is clearer when the disordered condition is a physical handicap.4 In that case it isn't morally wrong to be handicapped, yet it isn't " all right " to be physically handicapped either, except insofar as "it's all right" means that a person would rightly accept and love himself or herself, handicap and all. A disordered condition may involve a physical evil or perhaps a psychological evil, but does not necessarily involve a culpable moral evil. With this proviso the way is open for a frank discussion of Thomas's actual ideas about homosexuality. They are certainly worth the consideration of any contemporary philosopher or theologian who might be interested in this issue, and for others the subject involves a facet of the history of ideas well worth noting, expecially since from this angle it is easy to focus on Thomas's general thought about disordered conditions and pleasures. The investigation also forms a case study in the way Thomas used philosophy in forming and articulating his theology. Here, despite the fact that much of the material as Thomas expressed it has a theological formality and purpose, it is from philosophy that he derives his arguments, their thought structure, and their underlying insight. Visual research methods like photography and digital storytelling are increasingly used in health and social sciences research as participatory approaches that benefit participants, researchers, and audiences. Visual methods involve a number of additional ethical considerations such as using identifiable content and ownership of creative outputs. As such, ethics committees should use different assessment frameworks to consider research protocols with visual methods. Here, we outline the limitations of ethics committees in assessing projects with a visual focus and highlight the sparse knowledge (...) on how researchers respond when they encounter ethical challenges in the practice of visual research. We propose a situated approach in relation to visual methodologies that encompasses a negotiated, flexible approach, given that ethical issues usually emerge in relation to the specific contexts of individual research projects. Drawing on available literature and two case studies, we identify and reflect on nuanced ethical implications in visual research, like tensions between aesthetics and research validity. The case studies highlight strategies developed in-situ to address the challenges two researchers encountered when using visual research methods, illustrating that some practice implications are not necessarily addressed using established ethical clearance procedures. With his _An Interpretation of Nietzsche’s "On the Uses and Disadvantage of History for Life_", Anthony K. Jensen shows how 'timely' Nietzsche’s second "Untimely Meditation" really is. This comprehensive and insightful study contextualizes and analyzes a wide range of Nietzsche’s earlier thoughts about history: teleology, typology, psychology, memory, classical philology, Hegelianism, and the role historiography plays in modern culture. _On the Uses and Disadvantages of History for Life_ is shown to be a ‘timely’ work, too, insofar as it weaves (...) together a number of Nietzsche's most important influences and thematic directions at that time: ancient culture, science, epistemology, and the thought of Schopenhauer and Burckhardt. Rather than dismiss it as a mere ‘early’ work, Jensen shows how the text resonates in Nietzsche’s later perspectivism, his theory of subjectivity, and Eternal Recurrence. And by using careful philological analysis of the text’s composition history, Jensen is in position to fully elucidate and evaluate Nietzsche’s arguments in their proper contexts. As such Jensen’s _Interpretation_ should restore Nietzsche’s second "Untimely Meditation" to a prominent place among 19 th Century philosophies of history. (shrink)

Since the introduction of mathematical population genetics, its machinery has shaped our fundamental understanding of natural selection. Selection is taken to occur when differential fitnesses produce differential rates of reproductive success, where fitnesses are understood as parameters in a population genetics model. To understand selection is to understand what these parameter values measure and how differences in them lead to frequency changes. I argue that this traditional view is mistaken. The descriptions of natural selection rendered by population genetics models are (...) in general neither predictive nor explanatory and introduce avoidable conceptual confusions. Anthony Kenny offers a critical examination of Thomas Aquinas's influential account of being, arguing that it suffers from systematic confusion. Because of the centrality of the doctrine, this has implications for other parts of Aquinas's philosophical system. Kenny's clear and incisive study dispels the confusion and offers philosophers and theologians a guide through the labyrinth of Aquinas's ontology.

Editors provide a substantive introduction to the history and theories of perfectionism and neutrality, expertly contextualizing the essays and making the collection accessible.

In the past couple of decades several different accounts of the logic of practical reasoning have been proposed.1 The account I have recommended on a number of occasions is clearly the simplest, because it requires no special logical principles, holding that, in respect of deduction, practical reasoning is adequately understood as involving only standard assertoric principles. My account has recently encountered various objections, the most dismissive of which is that it is too simple to deal with complicated cases of practical (...) inference. I am not daunted by these objections. My aim here is to offer some observations that will make the merits of my account easier to appreciate. (shrink)

Current debate on business ethics in Australia continues apace as the excesses of the 1980s are exposed. Codes of Ethics have been a high profile instrument in the American business scene. A survey of Australia''s largest business corporations reveals a different situation. Codes are not as commonly used, tend to refer to legal requirements and do not have as high a profile within the corporation. Given the changing legal framework in Australia a greater role for Codes of Ethics may emerge.
